General Terms and Conditions (GTC) of ErkenntnisWerkstatt - Förderung von altem Wissen

1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded via all websites of the association ErkenntnisWerkstatt - Förderung von altem Wissen. The association offers the following services:

  • Online courses, seminars, workshops, and lectures (digital and physical events)

  • Guidance/coaching

  • Uniquely handcrafted leather goods

  • Photography services

  • 3D construction planning

The GTC govern the rights and obligations between the association ErkenntnisWerkstatt - Förderung von altem Wissen and its customers.

2. Contracting Parties

The contracting party is the association ErkenntnisWerkstatt - Förderung von altem Wissen, represented by its board in accordance with the association's statutes. The customer is the natural or legal person who books services or orders goods via the website.

3. Conclusion of Contract

  • The presentation of products and services on the website constitutes a non-binding invitation to submit an offer (invitatio ad offerendum).

  • By submitting an order, the customer makes a binding offer to conclude a contract.

  • The contract is formed once the association ErkenntnisWerkstatt - Förderung von altem Wissenaccepts the customer's offer through explicit confirmation (e.g., via email).

4. Prices and Payment Terms

  • All prices are stated in euros (€). According to § 6 para. 1 no. 27 of the Austrian Value Added Tax Act (Umsatzsteuergesetz, UStG), the services of the association ErkenntnisWerkstatt - Förderung von altem Wissen are exempt from VAT.

  • Payment shall be made via the payment methods specified on the website (e.g., credit card, PayPal, bank transfer).

  • For online courses, seminars, workshops, and lectures, payment is due before the start of the event.

  • For handmade leather goods and other physical products, payment shall be made according to the conditions specified during the ordering process.

 

5. Cancellation Policy for Lectures and Seminars

  • The customer may cancel booked lectures and seminars. The following cancellation fees apply:

    • Cancellation up to 4 weeks before the event: 25% of the total price,

    • Cancellation up to 14 days before the event: 50% of the total price,

    • Cancellation up to 7 days before the event: 80% of the total price,

    • Cancellation less than 7 days before the event or no-show: 100% of the total price.

  • Cancellation must be made in writing (e.g., via email). The receipt of the cancellation by the association ErkenntnisWerkstatt - Förderung von altem Wissen is decisive.

6. Delivery and Shipping Terms

  • Physical products (e.g., leather goods) will be delivered within the specified delivery periods.

  • Shipping costs will be communicated transparently to the customer during the ordering process.

  • For digital products (e.g., access to online courses), the customer will receive access credentials or download links via email after payment is received.

7. Right of Withdrawal under the Austrian Consumer Protection Act (FAGG)

  • The customer has the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period begins:

    • For goods: from the day of contract conclusion or receipt of the goods.

    • For services (e.g., online courses, seminars): from the day of contract conclusion.

    • If the customer uses the service before the withdrawal period expires, the right of withdrawal is forfeited.

  • The right of withdrawal does not apply to:

    • Digital products (e.g., downloads) if they have already been downloaded or streamed,

    • Services that have been fully performed and whose start the customer explicitly requested before the withdrawal period expired.

8. Warranty and Liability

  • The association ErkenntnisWerkstatt - Förderung von altem Wissen is liable for material and legal defects in accordance with Austrian law (ABGB).

  • The association assumes no liability for damages resulting from improper use of the offered services or products.

  • Liability for slight negligence is excluded unless essential contractual obligations are violated.

 

 

9. Data Protection

  • The association ErkenntnisWerkstatt - Förderung von altem Wissen processes personal data in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG).

  • The privacy policy, available on the website, regulates the collection, processing, and use of personal data.

10. Association Regulations

  • The association ErkenntnisWerkstatt - Förderung von altem Wissen operates in accordance with the Austrian Associations Act 2002.

  • Membership in the association is not a prerequisite for purchasing services or products via the website.

11. Final Provisions

  • The law of the Republic of Austria applies. In particular, the ABGB (Austrian Civil Code), FAGG (Consumer Protection Act), and the Associations Act are applicable.

  • The jurisdiction for all disputes is the registered office of the association ErkenntnisWerkstatt - Förderung von altem Wissen.

  • If individual provisions of these GTC are invalid, the validity of the remaining provisions remains unaffected.

12. Changes to the GTC

Right of withdrawal/right of cancellation

 

You have the right to withdraw from this contract within fourteen days without giving any reason.

 

The cancellation period shall be fourteen days from the date of conclusion of the contract.

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund.

 

If you have requested that the services begin during the cancellation period, you must pay us an appropriate amount corresponding to the proportion of the services already provided up to the point at which you notify us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract. This does not apply to digital content.
